Fontaine telephoned the lawyer and then told the subordinate police officer that Vaughan didn’t need to speak to a lawyer. Fontaine told the police constable to pass that informa. tion on to the impaired driving Suspect. Vaughan subsequently went to do a breathalyser sample, but provided a sample not suitable for analysis. Paradis said he “fully agreed” with the defences position that Vaughan’s Charter right to consult 3 lawyer had been violated. Paradis called the Charter breach by the police officers “flagrant” and an obvious interference. Paradis went on to say that Vaughan was arbitrarily arrest- ed by West Vancouver Police. Vaughan was arrested at 3 a.m. The judge said Vaughan was put in a police station jail cell and not released until the neat afternvon at 2 p.m. Paradis said the decision to keep Vaughan in a police sta- ton jail was made by the officer in charge (Fontaine) who only spoke to Const. Wilkinson. Construction begins on new Parkgate - Community Centre he site next to the Parkgate Branch is cleared and construc- tion of the new Parkgate Community Centre is about to begin.
