New child welfare act
narrows responsibility - judge

British Columbia's new child
welfare legislation narrows
the government's respon-
sibilities to deal with social
problems involving children.
Vancouver's head family
court judge says.

“You've: moved from a
piece of broad social
legislation. to. a piece of
narrow. legislation,” Judge

reviewing .the Family and
Child Service Act, in-
troduced Friday. .

Judge Campbell said
Monday the new iegisiation.
to replace the 79-year-old
Protection of Children Act,
introduces a more stringent
test for seizing a child for his
own protection.

The legislation -lists five
grounds for taking a child
into custody: abuse or
neglect endangering a child’s
safety “or ~well being..
abandonment, inability of a
parent to provide necessary
care, «deprivation of
necessary medicai attention.
or the child's absence from
home in circumstances that
endanger his safety or well
being

Judge

Campbell said

restricting the province's
right to intervene in the lives
of famihes may be a

‘progressive move so long as

the government still provides
services aimed at social
problems. But by restricting
its responsibilities toward
children, the government
also reduces its = ac-
countability for their
welfare, he said

in Victoria, New
Democratic Party human
resources critic Rosemary
Brown said the bill did not
include a statement of the
basic rights of children, the
appointment of an advocate
to act on behalf of all
children or a list of services,
such. as daycare, to be
provided by the government.

Brown said the legislation
