Smoking bylaws hammered RECENTLY announced provincial legislation will allow individual municipalities to pro- hibit smoking in various types of hospitality industry establishments. Geotirey Howes, vice-presi- dent of Government Affairs for the BC Restaurant and Foodservices Association (BCRFA), said the legislation is unnecessary because WCB reg- ulations will be coming into effect Jan. 1, 2000 which will ban all smoking in all hospirali- ty industry establishments province-wide. BCRFA is concerned that the new legislation will only serve to compound the current patchwork of bylaws that exists berveen different: municipali- ties and different classes of hos- pizality establishments. Local smoking — bylaws affecting, the hospitality indus- try are established according to liquor licence class (hotel, pub, restaurant ). One of the intentions of the WCB regulation, stated by both the government and the WCB, is to create a level play- ing field for all these hospitality industry businesses in protect- ing workers from environmen- tal tobacco smoke. Howes said the ongoing patchwork approach to health protection has only shifted smokers from one type of establishment to another and trom) one municipality to anocier. In) the meantime, licenced restaurants subjected co the 100% ban in Vancouver, Burnaby and New Westminster have seen their business drop by as much as 25%. Howes believes the provincial govern- ment’s motivation behind the new legislation secms to be a face-saving = measure for Burnaby council. In June, Burnaby’s bylaw was over- turned by the Supreme Court on the grounds that the Municipal Act only gives a kucal government the power to reg- ulate, not prohibit.
