Palffy and his wife frish, 29, moved into a suite ia the North Shore Winter Club site building last September and prompdy signed a once-vear tease. It’s. an attractive building that is alsa near his work, which makes it an idyllic setting. “Irs a beautiful building and for the most part the people we've been in contact with are very nice,” said Palffy. But some of the building's residents were nor happy to have them. There's an age restriction specifying that occupants of the building's suites be at feast 50 years old, making the Palttys illegal lodgers. As a result, the couple have received an eviction notice. “There's a for of hypocrisy and contradiction going on here,” said Palffy, adding thar many other under-age tenants live in the building. Others contravene pet restriction bylaws, he said. Carlton At The Club was built under the condition that at least one resident in cach of its 182 units is 50 years old or older. The condition is covered in a covenant that goes back to 1988 when developer Co-operarors General Insurance Company asked North Vancouver District for permission to build a rental complex for “active seniors.” The project was approved in 1989 with the covenant in place. In 8992. the district approved: a developer’s request to strani the building se that it would consist of individitally owned strata units rather than rental accommoadanuen The developer also asked to have the restrictive age covenant clim inated, but the district refused. o My aie and Pare pretessional people and we can easily afford to stay here,” said: Paltty. But in his case money iy not the issue, “Ustially its young people hassling older people,” aid Paltty. The owner of the suite with whom the Palttys signed their lease was herself forced to move out last summer because she had a pet. But, said Paltty, the woman did not disclose the age restriction to them at the dime. “Hlose my patience when [ find out we've been evicted because someone hasn't been straight with us,” said Palfty. Carhon At The Club strata corporation chairman John Noonan said he was unaware of the Palftys’ predicament and refused further comment. “TP think you better tafk to the property manager,” said Noonan. “I’m new to this.” However, Thomas Agnew, the building's property manag- er, said he had no comment on the matter. The age restriction issue was before the BC Court of Appeal earlier this year. The court ruled in favour of the dis- trict, stating the covenant is neither obsolete nor discrimina- tory. The decision affected several under-age owners of suites in the building. The Palttys’ landlord did not return News calls to press time Thursday. Fire hits West Vancouver Lawn Bowling Club WEST Vancouver firefighters spent two hours putting out a blaze at the West Vancouver Lawn Bowling Club last Saturday afternoon. The fire broke out in a six-week-old shed housing the club's Esty equipment. Approximately $40,000 to $60,000 worth of fawn mowers and other club gear was lost in the blaze, which fire- fighters are calling suspicious.
