Waste firm’s injunction upheld LIONS GATE Hospital bio-medical waste will continue to be trucked to Washington State for incineration until at least March. A Washington State bylaw banning the importation of bio- medical waste was scheduled to come into effect Jan. 1, but the company that hauls bio-medical waste from Lions Gate Hospital and other Lower Mainiand medical facilities to the Washington State incinerator won a tesuporary injunction delaying the bylaw’s implementation. As reported in previous News stories, BFI1 Medical Waste Systems Inc. filed for the injunction on the grounds that the bylaw is unconstitutional. On Friday, the U.S. district court ruled in favor of upholding BFI’s temporary injunction until the constitutionality of the bylaw has been determined by the courts. A court date to hear the case will likely be scheduled in February or March. The Washington State incinerator is currently the main facility used by BFI to dispose of Lower Mainland bio-medical waste. B.C, has no facility for bio-medical waste disposal.
