In a referendum on Nov. 17, 1990, West Vancouver res- idents voted against building a golf course on Cypress Ridge. As a result of the vote council passed a resolution rejecting the proposed golf course. Hynes and Sojonky chimed the municipality breached its contract with them to enter into a lease for a 27-hole course. = Price Waterhouse placed the present value of the lease at $5.5 mil- lion while BDO Dunwoody reported the fair market value between $500,000 and $1.1 million. The plaintiffs also claimed‘ they were entitled to the value of the work already done on the project and damages against West Vancouver for negligence and misrepresenta- tion, Although the matter was initially set for trial May 31, 1993, it was adjourned to May 1994 due to the unavailability of a judge. When the plain- uff's counsel was unable to attend the trial the matter was further postponed until Feb. 24, 1997. The settlement was reached on Feb. 14.
