Gardom recently announced the proclamation by the Provincial Cabinet of British Columbia’s new Family Re- lations Act which introduces the principle of equal sharing ‘of family assets in the event of marriage breakdown. This sharing only applies after a breakdown and it must be fair to all concerned. Under the new Act the Supreme Court of British Columbia has discretionary power to reapportion family assets if equal sharing is judged to be unfair in light of the circumstances of | the marriage or the financial need of a spouse. The Act, passed in the Legislature last year, takes effect at the end of March. Among other things, the Act: e Makes the rights and interests of children the paramount concern in court proceedings; ¢ Introduces the system of deferred sharing of family assets; ¢ Established provisions for a marriage agreement wherein spouses can specify their own alternatives to the deferred sharing rule: charge © Clarifies the liabilities for support and maintenance of parents, spouses andchildren;. e Provides for automati enforcement of maintenance orders; : © Provides for the use . of family advocates and family court counsellors. in announcing the pro- clamation, the. Attorney- General called the Act a milestone in the evolution of family law in British Columbia. ‘‘It is’? he said, “the fairest legislation of its kind in Canada.”’ “We have to recognize the frequency. of marital break- down in our society,” he observed. This Act clarifies the rights and the obligations of everyone unfortunate enough to be involved in the breaking up of a family. One of the most important aspects of the Act, said Gardom, is that it places the rights and best interests of children above other consi- derations in the court pro- ceedings.
