- CONTAMINATED FACTORY LAND WAS BAD DEAL

“Dad, where are you taking tne?”
"Ronald leaned back in the thick leather seats of
- his father’s Cadillac convertible, and smiled.
’ “Actually, you can take me anywhere in this
cat, This is the life.”

Sam beamed. “Son, | want to show you
= your inheritance. A building. Now. don’t
_ judge it too fast. The building is an old,

“ tundown paint factory that has to be torn

“down, But.the land is worth a fortune,

} Especially when we turn it into the classiest
* residential area in the city.”

Ronald suddenly sat up straight. His taw
training started sending signals in his brain with the
speed of ‘strobe lights. “You want to build homes on

’ factory land? A paint factory? That's crazy! What if the

" earth is contaminated? Have you thought of that, Dad?
»: Paint factories are known to have emptied all their toxic
__ waste into the earth. Did you have an environmental,
audit done’ of the land?”

Sam's face became grim. He started muttering under
“his breath,

” “My smart-alec son with all his smart-alec questions, |
send him to the country’s finest law school and suddenly
he thinks he knows more than his ofd man.”

The car pulled into the factory grounds, Ronald took
one look at the building and his eyes almost popped out
of his head.

The seller argued, “Your honor, | am an honest
businessman. I had no duty to disclose the contents of
that report. He never told me about building homes.
Anyway, anyone can tell it is contaminated. There is a
containment well, pump shed and holding tank. It was a
factory. He knew what he was buying.”

Should the sale be set aside? YOU BE THE jUDGE.

DECISION:

“*SORRY SAM,” the court said. “You knew you were buying a factory. The contamination was obvious. The
seller didn’t have to tell you about the report. If you wanted to use the place for building homes, it was up to

you to ensure that the property could be used for that purpose.”
