restricts
satellite siting

SATELLITE RECEPTION
may run into some interfer-
ence in the District of North
Vancouver now that a bylaw
amendment regulating the
siting of satellite dish anten-
nae has been adopted by
council.

Satellite dish antennae are typi-
cally 10 or 12 feet in diameter due
to the output power of the satel-
lites. They require a clear view of
the satellites to be received, and
the preferred residential installa-
tion location is on a south-facing,
inground cement base close to the
house. Roof locations are generally
eliminated to all but commercial
installations because of the weight
requirements.

The installation of a TV satellite
antenna in the front yard of 2756
Byron Road led to council's con-
cern regarding the lack of ap-
plicable tegislation and a request
for legal opinion as to potential
municipal authority in the matter.

Ald. Murray Dykeman, in pro-
posing the new bylaw, said: ‘‘The
intent is to regulate such sitings to
the rear yard location rather than
anywhere, as it is at the present
time."’

In a report to council the
municipal solicitor advised: ‘In
our view, the district may regulate
the height and siting of satellite
dish antennae so long as the regu-
lations are reasonably related to
gerzral municipal concerns and are
not unreasonable or discrimina-
tory.””

Municipal planner Kai Kreuchen
confirmed that dishes already in
place in a front yard would be
legaily non-comforming and would
not have to be moved as the bylaw
amendment is not retroactive.
