SENTENCING of North
Vancouver District on four
counts arising from pollution
of Lynn Creek by leachate
from the municipality's
Premier Street landfill was
adjourned Monday.

Judge John Layton will
hand down = sentence in
North Van provincial court
February 11.

The request for ad-
journment was made by
Larry Schafer on behalf of
District's counsel, John
Mackenzie.

District had pleaded guilty
January 11 to four counts of
allowing deleterious sub-
stances to enter Lynn Creek
from the garbage dump and
a stay on proceedings was
issued on a further four
similar charges.

During the trial, Crown
counsel Digby Kier, who
maintained District had been

“extremely negligent” in
preventing pollution of the
creek, referred to two other
cases.

Sentence had been ad-
journed so that District's
counsel and Judge Layton
could study transcripts of
those cases.

But Kier told the court
Tuesday he had had dif-
ficulty obtaining details of
the two cases and had only
received the information the
previous day.

The adjournment was
made so District’s counsel
could have an opportunity to

study the transcripts of the,

cases and then respond to
the details with a written

- submission.
