Drug conspiracy trial dropped THE B.C. Supreme Court drug conspiracy trial of West Van- couver’s James Lloyd Hurford and five other men was granted a judicial stay of proceedings last Friday. By Bob Mackin Jr. Contributing Writer In his decision, Justice Stuart Leggatt cited the unreasonable length of the trial and concerns for the right of the accused to a prompt hearing. The trial, originally scheduled for nine weeks, began last April. It was adjourned to the fall after six of the nine weeks were used to test the admissibility of volumes of evidence. When the trial resumed in Oc- tober, Justice Leggatt predicted a verdict would not be reached until the new year. But about a month later he dismissed the jury. Several jurors wrote to him complaining of personal and economic hard- ships because of the lengthy trial. A new jury was readied for the new year, but a mistrial was declared when one juror was ab- sent. The trial was back on track again last month, but came to a screeching halt with last week’s judicial stay. The proceedings stemmed from a September 1987 incident near Port Hardy. An undercover police boat carrying three tonnes of marijuana on Joan to the RCMP from the U.S. Drug Enforcement Agency was met by another boat and towed to a cove near Ratten- bury Island. According to the Crown, the men on the boat off-loaded what they thought was a_ 19-tonne shipment of Thai marijuana. The delivery of the $80-million load, the Crown alleged, was arranged by two members of a Virginia- based, white Sikh cult who made a deal with police informants to ship the narcotic to a ‘‘safe’’ loca- tion on the west coast. But as the result of last week’s B.C. Supreme Court decision, all charges of conspiring to import and traffic marijuana initially laid against Hurford, Frank Peter Bailey, Paul Richard Bragg, Christopher Kemp Angus, Richard Hale Stewart and Christopher Speedie were stayed.
