10 - Wednesday, March 24, 1993 ~ North Shore News NV man awarded pay in unfair dismissal suit A 60-YEAR-OLD North Vancouver man who was fired without notice or cause has been awarded nine months’ pay by the B.C. Supreme Court in Vancouver. In a decision released fast Fri- day, United Gear & Machine Works Ltd. was ordered to pay Michael Simmons after a conten- tious 1991 dismissal, Simmons, who was 58 at the time of his dismissal, had been steadily employed by United Gear in North Vancouver for seven years as a lathe operator. The dismissal came %-hour before closing on Aug. 23, 1991. Simmons claimed that Thomas Watson, the company manager, approached his work station and fired him. The worker claimed he was | asked: ‘‘Mike, do you want it at _ 4:30, or do you want it now?” According to Siiumons, the manager then added: ‘‘You’re through — you're finished.’’ The company contended that the worker had been laid off, not ' fired, and that no notice was nec- essary. | : But Mr. Justice Albert Mackoff agreed with Simmons’ contention By Brent Mudry Contributing Writer that a later recall notice was not a genuine job offer. “In my view, the so-called “recall? was simply a sham — a pretence,’’ noted the judge. “1 find that Mr. Simmons had been summarily dismissed in an abrupt and unfeeling manner,” Mr. Justice Mackoff said. Simmons said after the judg-— ment that “I did nothing wrong, and I was very disappointed with the way I was treated.’’ Despite diligent efforts to find work, Simmons is still unem- ployed. United Gear conceded that the. Simmons had been a very satisfac- tory employee. ‘i'd just like to find another job now,” said Simmons, who has over 30 years’ experience in machine shops. And he has now been charged with a February sexual assault in Matsqui while in protective custody. -Mark Napierala, of Burnaby, was unable to appear in B.C. Supreme Court in Vancouver on Wednesday, March 17. The West Vancouver . charge against Napierala arises from an alleged August 1991 ‘assault in Ambleside Park.
