Help’s at hand HELP’S AT Hand, a weekly feature by the North Shore Infor- mation and Volunteer Centre, an- swers questions about and such topics as govern- ment policies and programs, benefits, consumer and legal rights, taxation and public ser- ices. Question: Four months ago my- husband ead I acparated. We necd to come to an agreement about how mech time our three childrea wil spend with each of as, and how much meney is appropriate jor their support. Why would mediation be better tham going through the normal legal process? Amswer: Mediation works with the legal systsm by providing you with an opportunity to informally get together and work through some of the decisions that you have to make before going through the court. You will be helped to identify concerns and ijind solutions that are fair to both of you. The agreements that you make in the sessions take into consideration the needs of yourselves and your children. Mediation helps both parties get what they need in a conflict situa- tion. The court system ensures that one person wins and one loses. Mediation can be arranged within a short period of time, and a solution is usually reached after one or two two-hour sessions. Mediation is also much less expen- sive than the court system. You can consult with your law- yers at any time during mediation. You can also go to your lawyers to formalize the agreements made during mediation, and to ensure that your legal rights are protected. that my dogs bark ioo much and are general nuisances. I boilt a fexce and usually keep the dogs in the house, except for short periods when I Iet them out. The neighbor blames any barking on my dogs and frequently sends for the police. My neighbor refuses to talk to me sbout it. He simply insists that my dogs must go. Ca2 I take my neighbor to mediation? Answer: Mediation cannot be imposed on anyone. It only works when two people: are willing to meet, discuss and work out their differences. It is very important that each person genuinely wants to find a solution to the problem and is will- ing to listen to the other’s point of view.
