E (beside Aamco) Bart - 984-3 166 Corinne Jackson Maple Ridge Times Eli McGinty was sen- tenced to six years behind bars for the killing of his buddy, Maple Ridge’s Phillip Patrick Barry. The North Vancouver man has already served more than two years since being arrested and charged in the June 4, 1996 stabbing death. Other than Judge Frank Cole, Crown prosecutor Bob Bonner, defence lawyer John Banks, some court staff and a couple reporters, McGinty was alone to face his sentenc- CARPET RESTRETCHING + repairs, squeaks & installation sorry — no carpet sales Ken McKenzie 27 years experience 924-3486 q ing in a New Westminster courtroom. Originally charged with second degree murder, a jury came back Sept. 24 finding McGinty, 27 at the time of guilty of the — incident, manslaughter. During the trial, the jury heard how McGinty and 33- year-old) Barry were out drinking and came back to Barry’s Maple Ridge home late on June 4. A fight broke out between Barry and the two men’s common-law wives. Barry turned on McGinty and the women fled upstairs with their infant sons. Police found Barry minutes later lying in a pool of blood in the carport and MeGinty standing near- by. In determining a sentence, Cole Jooked to MecGinty’s previous criminal record and the fact that McGinty was born addicted to speed. McGinty served time for assault with a weapon in 1994, and was on 18 months probation for assault when he killed Barry. As well, Cole considered a presentence report which suggests McGinty has a sub- stance abuse problem. “It’s always a tragic thing when people are killed. And it’s tragic a friend dies at the hand of a friend,” Bonner said, minutes after sentenc- ing. Bonner asked for five to seven years and a lifetime firearms and ammunition ban. Defence lawyer John Banks suggested three years. Along with the six years, Cole agreed to the firearms ban. The TIMES was unable to reach Banks for comment. OWUN PAC OF ~ Swim, Skate & Draw!
