10 — Wednesday, August 11, 1999 — North Shore News Dear Editor: Re: Leo Knight’s July 21 column “Hells Angel’s case frustrates police.” U represented Mr. kmond in the matter of his extradition to the US., the subject matter of Mr. Knight's article. Please note the following facts: 1. The Canadian federal Prosecution amended the charges against Mr. Emond in Montreal, Quebec, in 1987 with the agreement of the District Attorney for Florida, in order to accommedate the then outstanding U.S. charges in Florida. 2, When the Canadian court (judge) was apprised of this, he asked that the district attorney for Florida be contacted to con- firm his agreement to the court. The court was stuod down and a US. Customs agent did so north shore news MAIL Box and thereafter took the stand, was sworn and advised the court under oath he had indeed Ken to the district attorney for Florida, Mr. Chayken, and that he was speaking on behalf of the state of Florida who was in agreement with: a) an amended global charge encompassing the state of Florida allegations and charges against Mr. Emond; b) a global sentence of nine years. Not onc word was heard from the state of Florida until late 1993 when Mr. Emond was released on parole. S GO charges against Mr. Emond Were new and post-1987 were the subject of a careful review by the justice minister's office and the Department of Justice’s International Assistance Group. To that end a special inde- pendent Crown attorney was appointed to investigate this by the Attorney General of Canada. He attended Florida, investi- gated and found no support for their allegation. As a result the justice minister was advised that the state of Florida’s request was based on the sam. facts and allegations. Your Mr. Knight’s opinion that Floridi’s request “sounds like a reasonable argument” to him, is as you can see, com- pletely devoid of a fact base. Other allegations in his arti- cle are also completely unfounded. Are we to believe Mr. Knight, that if Mr. Emond had breached his bail cerms, the police wouldn’t have loved to arrest him and have his bail revoked? 2. “Police sources claim Emond is every bit as active as ever...” If that’s true and evidence exists, instead of rumour and gossip coupled with police sour grapes, charge him with offences so he can deal with them. Don’t make alleyations you cannot support. As they say, talk is cheap. 3. “Emond is still here.” (B.C.)
