book on contracts

A NORTH Vancouver real-
tor has written a book on
real estate contracts that she
says will lead to added
benefits for both a house's
purchaser and seller.

Jordy Higgins, along with
fellow real estate agent Nan-
cy Bain, put together The
Enforcer, a book designed as
a realtor’s reference guide to
contracts.

“There was not a publica-
tion like this in existence,"*
said Higgins. ‘‘There is no
source material (of this
type)...and there never has
been.”

In the book, the two shat-
ter some of the myths of the
real estate business.

For instance, one myth is
that owners can ask tenants
to vacate a property when it
is put up for sale. Sale is not
a justifiable reason for evic-
tion.

Another myth is that te-
nants in illegal suites do not
have rights under the Resi-
dential Tenancy Act. Those
tenants have the same rights
as other tenants.

“For real estate practi-
tioners it’s just a handy
guide for drafting contracts

— no kidding, sometimes
it’s on the hood of our car."*
said Higgins.

means that “every aspect of
the transaction has been
thought out," added Hig-
gins. ‘‘The whole object is to
draft a contract that is cn-
forcable by law. That
benefits the purchaser and
the seller.""
