Legal Director, Public Legel Education - If you have no previous experi- ence with ICBC claims, you may feel pressured to accept the first offer that is made. Take your time before you decide to settle, and don’t let yourself be pressured. If ICBC doesn’t make a reason- able offer to settle your claim you can always start a legal action. This legal action must be started within a certain time period, in most cases two years from the date of the accident. Unfortunately, there may be other time limitations that apply to your case. For example, if you have an ac- cident with a vehicle owned by a municipality, you may be required to start a legal action within six months. Time limitations can be confusing, so if you are unsure about any that might apply in your situation, contact a lawyer. Here are some suggestions on when you should settle your claim: 1) Never settle a claim until you have received 2 fall medical report from your doctor and never settle until your injuries have stabilized. If you are getting near the time limitation to start a legal action and your injuries have still not stabilized, then contact a lawyer. If you don’t take steps to start a legal action you will Jose the right to claim any money from ICBC. 2) Never make a setilement while you are under medication, while you are recovering in hospital or at any time when you might be at a. disadvantage. In fact, you should not even meet with an adjuster unless you are clear-headed and aware of what you are doing and saying. ‘ . If an adjuster comes to see you in the hospital when you are not thinking clearly or while you are” under iaedication, then tell the ad- juster that you will make an ap- pointment to meet at a later date, but that you are not willing to discuss the accident at this time. 3) Ask for time to think about the offer before you decide whether or not to settle. Once you - have settled your claim, there is no going back. You will be asked to sign a release form which prevents you from making any more claims from that particular accident. Since a claim settlement is final, take the time to think about the offer. IF you are not sure whether the offer is fair, then contact a lawyer, but above all don’t be pressured into accepting the offer quickly. If the adjuster tries to pressure you into accepting the offer before you have a chance to think about it, then be warned — the offer may not be a good one for you. Unfortunately, there are no simple rules about how much a particular injury is worth. Students who complete the first year of automotive trades training at Fraser Valley College or another provincial institution receive credit for the first level of apprenticeship training. After they enter the workforce, they must return to a designated institution for five weeks of formal training for each of the remaining three years of their apprenticeship. Until the restraint period in education began six years ago, the Fraser Valley College did provide some advanced apprenticeship training. In January this year, the college again began to offer ad- vanced five-week training sessions in the automotive mechanics area. Since then, three groups of ap- prentices in classes of 16 students each have completed first and se- cond year apprentice training ses- sions. Next fall the college plans to run up to five classes in advanced level training to almost 100 ap- prentices. When enough appren- tices require further upgrading, third and fourth year levels will also be offered. “The big advantage to many apprentices is that they don’t have to move into the Vancouver area for five weeks,”” says FVC Trades Department director Harvey Mc- Cullough. ‘For the college, it means an important addition to our programming because we can now offer our first-year students the opportunity to complete more of their apprenticeship without leaving home.’’ During the five-week advanced apprenticeship training sessions, tuition fees and a living allowance are paid by the Ministry of Labour. McCullough noted that a year ago the college’s local Trades Ad- visory Committee, which is com- prised of representatives from the local automotive industry, had en- couraged the college to pursue this advanced training. With approval from the Ministry of Advanced Education and Job Training last fall, the college was able to meet this request. Interest in advanced appren- ticeship training has _ increased sharply over the past two years as the economy and job market have improved. At present, all Fraser Valley College Trades programs, including the automotive, heavy duty and commercial transport mechanics, parts/counter person, welding/fabrication, drafting, and carpentry/joinery, are almost filled to capacity.
