Trevor Carolan for raising a voice of dissent against coun- cil’s resolution to support a political lobby group called the Repeal 43 Committee, which is trying to make it ille- gal for parents in Canada to use reasonable corporal disci- pline to correct their children. As a lawyer who _ has researched the application of Section 43, I feel compelled to provide your readers with some information in defence of maintaining this section of the Criminal Code. Section 43 does nor give parents a right to hit children. It provides them with a legal defence if they are) charged with assault, but only if they are able to prove to the court that their actions were “rea- sonable in the circumstances and intended for the correc- tion of the child.” In the case R vs. Ogg- Moss (1983), the Supreme Court of Canada set out explicit guide- lines that courts must follow when determining if a parent acted reasonably. The Repeal 43 Committee makes an unqualified state- ment that Section 43 has been used to justify hitting children with “sticks and extension cords, Igaving bruises, welts and abrasions.” However, most of the cases it refers to are decades old and do not accurately reflect: the court’s much more restrictive use of Section 43 today. Also, the committee does- n’t explain that strict chiid protection laws exist in every province to protect: children from abuse and neglect. Section -£5 serves a valuable purpose in that it provides par- ents a small measure of pretee- tion against unjustified state interference in family matters. The vast majority of Canadian parents love their children, know them individually and are in the best position to make disciplinary decisions. I support a recent statement by the organization Focus on the Family in which they state that “parents, not government, resent the voice of North Vancouver residents on. par- enting matters?
