Supreme Court grants permanent injunction to NVD to restrain shooters

silenced in a long-running feud between
a group of Lyan Valley residents and
the North Shore Skeet Club (NSSC).

B.C. Supreme Court Mr. dustice John Bouck
has granted North Vancouver District's applica-
tion for a permanent injunction restraining the
“skeet club from breaking the municipal nvise
bylaw.

A further. provisional order sought by the resi-
dents was also handed down April. 13. Hrestrains
the club from shooting pending trial of their cam.
mon-law ouisance suit.

Both injunctions were effective immediately
and will prevent the shotgun noise that has
angered residents in the area of Robinson and
Draycott roads for years,

“The important thing is that the decision in the
district’s application is a permanent injunction,”
said NVD lawyer Dan Bennett, of Bull, Housser
and Tupper.

Bennett said that if the skeet club contravenes
the noise bylaw again, a contempt of court aclian
could be filed that could result in possible fines
or even imprisonment of club directors,

But the more serious consequence to the club
from the court ruling is that the distiict can now
inform the Greater Vancouver Water District,
which holds the NSSC tease. that the club ts in
contravention of the district noise bylaw anid
reyuest termination of its tease, forcing, the club
off the North Shore.

Although noise testing by health inspectors
has found that the noise from shotgun shooting is
within tolerance for “continuous sounds” the
action was initiated under section 4a of the dis-
tricUs noise bylaw, which covers the nuisance
factor of noise.

FL states:

“No person may make or cause or allow to be
made by any person, animal, bird or thing, any
noise or sound in or on a highway or elsewhere
within the District of North Vancouver which
disturbs or tends to disturb the quiet, peace. rest,
enjoyment. comfort or convenience of the neigh-
borhood or of persons in the vicinity.”

Said Jerry MacNeal, a member of the skeet
club since 1957, “lm waiting to talk to a lawyer
to see what we're going to do.
