Trees in the Orkney Place and Larkhall Crescent area have been falling since August, with the most recent incidents occurring in last week’s heavy winds. On Monday night several fami- lies fom the area, which is north of Seymour Parkway between Emerson Way and = Strathaven Drive, pleaded with council for quick action in identifying and removing trees judged to be dan- gerous, Larkhall resident Carol Balderston said she wanted ‘‘all isolated tree stands taken down and replaced with vegetation suit- able for a community neighbor- hood.”’ She presented council with pic- tures of blowdowns lying across sidewalks, next to park benches and eight feet (2.4 m) from house windows. Balderston, her voice shaking, said it was a miracle that children had not already been hurt. Orkney Place resident Patricia Kienzle has written to council twice since a trec on district property fell onto the roof of her house in October. She said that although the dam- age was minimal, her three children — aged seven, six and four — were at home with her and her husband when the tree fell. ‘*|. needless to say (the children) were scared to death. It was one of the most frightening experi- ences I’ve ever had,’’ Kienzle wrote in a Nov. 25 fax to the district. She requested ‘immediate ac- tion'* from the district in remov- ing ‘“‘the remaining trees on our lot and adjacent area to ensure the safety of life in our new neighbor- hood.”’ Having received ‘‘not one response either written: or verbal’’ by Dec. 13, Kienzle wrote again to the district’s mayor aud council. In the meantime, another wind storm resulted in more blowdowns and, according to a concerned el NORTH VANCOUVER DISTRICT COUNCIL by Martin Millerchip Kienzle, two more houses in the neighborhood being hit by trees. “If these trees are not removed by the district immediately this letter acts as notice 10 the district that we shall hold the District of North Vancouve: liable for all damages personal or property, adjacent properties or persons in- cluding all costs for cleanup resulting from the trees on our lot and adjacent properties,’’. wrote Kienzle. Area resident Derick Sinclair is also threatening legal action against the district. Sinclair has purchased 1828 Larkhall Cres., effective Dec. 29. He said he was advised by both his builder and district forestry technician Ron Myers that before construction started, the district had identified a number of trees on his property as ‘‘healthy and stable.” Under a policy instituted this year, trees on district tots sold by auction are to be retained wherever possible. As a condition of sale control- led by covenant, the trees on Sinclair’s lot had to remain on the property. According to Sinclair, one of the trees then fell on his house while the building was under con- struction, and on Dec. 9 ‘‘another seven trees came down.” “To say | am concerned is an understatement,” said Sinclair in a letter to mayor Murray Dykeman. Sinclair would tike the covenant that requires him to preserve the “remaining”? trees on his property adjusted. “Should these trees fall within the first year of my owning the property | will sue the District of See Resident page § Index Mall fir Cc Classified Ads.
