Singer, songwriter and West Vancouver resident Sarah McLachlan, along with her husband Ashwin Sood, applied to West Vancouver council in May to extend an exist- ing fence, build another six-foot-high (1.8 m) fence and construct a gate and parking area at the rear of their property. As with the existing fences and gate that enclose the lot, all of the new additions would encroach onto district property. On Monday, council debated whether the couple should be charged for encroaching on public land, or for blocking the view from the street of a nearby creck, “Council policy has always been to decide whether to allow encroachments — not to charge for them,” said Coun. The = district’s bylaws define a boulevard to include any unopened area of road: the area between the proper- ty line and the roadway, unopened roads, unopened lanes and unopened street- ends. It's all part of West Van's village-like charm: narrow, twisting streets, lined with trailing plants, thick bushes and overhanging trees. But in some cases, the trailing and overhanging has become CLK a downright unsafe for pedes- trians and vehicles. Care and maintenance of a boulevard, and the plants that grow in it, fall to the owner of the property which it borders. But there’s wide variation in the degree of maintenance by homeowners throughout the district. And that’s caused problems. On Monday night, West Vancouver District Council voted to adopt a new Policy for Municipal Boulevards and Lanes, and that a draft of a new bylaw on the issue be referred to the Select Committee on Bylaws.
