As the law stands, the mortgagor whose mortgage is assumed by the buyer of his property remains liable for the total principal and interest owed, should the buyer subse- quently default. The result for the seller who no longer owns the property can be _ financially disastrous, as in the present case of the West Van couple suddenly saddled with a $170,000 debt and the threat of losing their own mor- tgage-free homie. Theirs is only one of numerous similar horror stories throughout- the province. NBP MLA Lyle MacWilliam has now called on the Legislature to revise the law so as to enable the lender, in case of default, to take action against the current mortgagor (the defaulting buyer) rather than the origi- nal mortgagor (the innocent seller), as is already the law in Alberta and Ontario. This is only fair and logicai. The buyer who owns the property is ob- viously the one who owes the money. If the lending institution has. any. doubts about him, it shouldn’t let kim assume the mor- tgage in the first place. If it does permit the assumption, presumably because it trusts him, its contract should be with him slone — in exactly the same way as if it had granted the buyer a new mortgage independently. Holding a blameless third party equally responsible for the debt makes the deal much safer for banks und trust companies, of course. But it offencs against basic concepts, of common justice. The place of origin figures, given that West Van fights with Victoria and White Rock for the title of geriatric capital of Canada. The group is the Senior Citizens Special Services Committee and it’s a very real lifeline to scores of “golden years’’ citizens, especially the less mobile. For example, the volunteers phone around 50 sbut-ins every day. They provide transportation to doctors, therapy, banks, the hospital and some hairdressers. They send out ‘‘Sunshine Lady” greeting cards, pay regular visits and assist the elderly in a hundred other ways.
