Neighbor must pay for cutting down trees

A SECOND major court award has been made to a
North Shore resident after trees were cut down by a
neighbor without permission.

A Vancouver county court judge awarded $71,300
to West Vancouver airline flight attendant Roswitha
Byford Oct. 13 after she had alleged one of her
neighbors had topped and thinned some of her hedges
and trees April 25, 1984 to improve his view.

Following the jury trial, the judge ordered the
neighbor, interior design consultant Marco Alfredo
Guidobono of 4481 Marine Drive in West Vancouver,
to pay damages to the plaintiff that included $50,000
in punitive damages.

The judge also ordered Guidobono to pay $20,000
for loss of privacy and inconvenience and $1,300 for
restoration.

Ted Ewachniuk, the lawyer for the plaintiff, said
Tuesday he will return to court to ask for interest on
the damages awarded.

The award, he said, underlined the seriousness with
which the courts and the general public view the
unauthorized removal of trees from private proper-
ties.

In July a B.C. Supreme Court judge ordered
William Hall of West Vancouver to pay $60,000 to
Lawrence and Ynez Kates after 13 trees on the cou-
ple’s three-acre West Vancouver estate were chopped
down.

Ewachniuk said the message was clear: ‘If you are
going to do this...you are going to get a spanking and
one heck of a spanking.’
