Question: The landlord of. my
building has increased the rent of
my apartment every year on
September 1 ever since I have lived
here. The increases have never
been very large and I have always
managed to pay the increased rent.

But this‘ year we’ have a°.new

so much that I think I will have to
move. I always thought that the
landlord was only allowed to raise
the rent by 10 per cent per year

and this latest raise is mach more |

than that. What can I do about it?
Answer: The Residential Tenan-
cy Act allows the landlord to raise
the rent once every 12 months and
he must give you three months
written notice of the rent increase,
but the amount by which the rent
is raised is not controlled by Jaw.
However, some tenants’ have
found that by forming a committee
to negotiate with their landlord
they have been able to achieve a
more reasonable rent increase. :
If you feel that your rent has
_ drastically. increased with the
specific intention of getting you to
you; cam .sue your
landlord in Small Claims Court for
your moving costs and any in-
creased ‘rent you -were forced to
pay. You must file a claim within
three months of moving out, and
you must be prepared to prove ei-
ther that the landlord increased the
rent with the intention of forcing

you to leave or that. the lanillord
has not been able to re-rent the
unit for at least.90 per cent of the
increased rent within two months
of the time you moved out.-. >

cannot do much about your
neighbor’s fence as long.as it is on

property.
. In North Vancouver Distiict. ‘the
heights are six feet.in the front of
the property and eight feet at the
back. In West Vancouver there is
no height restriction at all.

Your best course of action might . ,

be to negotiate with your “neighbor
and try to reach a compromise on
the size and style of the fence be-
tween your properties. Often of-
fering to share the cost of the fence
will make a neighbor more willing
to see your point of view and,
together, you could ‘decide on a
fence that would. Please both of
