You may be asked to pay a se- curity deposit when you make a tenancy agreement. This is the on- ly time the landlord can ask for 2 security deposit. The landlord can’t ask for more than ‘one security deposit per renta! unit, no matter how many tenants there are. It’s against the law to demand more than half the first month’s tent. You must pay the security deposit within 30 days of making the tenancy agreement. If you don’t, the landlord can evict you with one month’s notice. Before you move in, inspect the property together with your landiord. If there are stains on the rug or holes in the walls, write it down. You could take pictures, or even a home video, to show the condition of your rental unit. Make sure both you and your landiord have copies so there are no disagreements when the tenan- cy ends. The tandlord can deduct money from your security deposit if: @ You damage the property, then 44 The landlord can’t ask for more than one Security deposit per rental unit. 9F the landlord can withhold the se- curity deposit to pay for the repairs. @ You don’t leave the property reasonably clean, your landlord can deduct the cost of cleaning. @ You owe rent when you leave, the Jandlord can deduct the amount from your deposit. @ You give less than one month’s notice before leaving, and if the landlord honestly tries but can’t rent the unit right after you leave, then the landlord can deduct the lost rent money. lf you disagree with the deduc- tion, you may apply to the Resi- dential Tenancy Branch to appoint a neutral person to hear both sides of the story and make a decision. When you leave your rental property, the landlord has 30 days to: ® provide you with a statement showing the amount of the securi- ty deposit, the interest you earned, and the reasons for any deduc- tions; and @ refund your security deposit (or the balance of your security de- posit if deductions have been made). If you agree that a written statement is not necessary, then the landlord is not required to provide it. The following must be paid: | @ 1992 — 3.5%; © 1992 — 8.25%; © 1990 —- 9.0%; interest rates sides of the story. This costs $35. You can get an application form for this at a government agent's office or from Residential Tenancy Branch offices in Bur- naby and Victoria. At the hearing, both you and the landlords may show evidence, such as notes, receipts, and photos, to support your claims. The arbitrator will make a final decision on your case.
