We will be moving in on the first of next month. Our landlord is insisting that each one of us pay a security deposit, totalling almost $1,000. We will come up with the money if we have to, but is this tegal? He doesn’t seem to trust us. Hiow can we protect ourselves? Answer: The landlord has a right to ask for a security deposit which is his way of protecting his property against damage. The law says the security depos- it must be no more than half of the first month’s rent. It also says the landlord cannot ask for mare than one security deposit per rental unit, no matter how many tenants there are. Let’s say your rent is $800 per month. The maximum amount of security deposit that he can ask for from all of you is $400. : It is probably a good idea if all three of you contribute equally to the security deposit. If someone moves, their portion of the securi- ty deposit can be returned to them, providing that they have not caused any damage or have outstanding debts to the other te- nants. . This transaction will have nothing to do with the landlord; he is ur “er no obligation to return the sec: iy deposit or a portion of it un-i the tenancy with ail of you ends. Therefore it is a good idea for you as housemates to have a **co-tenants’’ agreement, In it you can state what the conditions of returning security deposits are. The co-tenants agreement is also.a good place to make a con- tract about other things like household expenses, guests, pets or chores. You should also have a tenancy agreement with your landlord. It should be in writing, and should include the names of all tenants and your landlord’s name, the address of the house, the amount of the rent and the due date for rental payments, and the amount of security deposit held by the landlord. Other special terms you agree to should also be included in the agreement. In answer to your question about protecting yourself, you can inspect the property together with your landlord before you move in. if there are stains on the rug or damage on the walls, write it down. If possible, take photographs of the condition of the house and make a copy for your landlord. This should avoid disagreements about damage when your tenancy ends.
