14 — Sunday, December 22, 1996 — North Shore News Homeowners sue NV District By lan Noble News Reporter THREE North Vancouver home owners are suing the District of North Vancouver for dam- age that occurred in the wake of a broken water main. In statements of claim filed in the B.C. Supreme Court Dec. 16, residents of three Glencanyon Drive homes in Upper Lonsdale are suing the district for a tora! of $62,840. The statements of claim state that on or about June 18, 1996, a water main located under Glencanyon Drive burst. . Water escaped and damaged the owners’ property. - ° Owners say the district breached its duties to the residents by failing to: @ cnsure that the water main was properly laid out, constructed and = main- tained; @ ensure that any and all repairs to the water main were made promptly and reasonabiy; @ formulate a reasonable policy and program for replacement and repair of the aging water main infra- structure, given the inci- dence of water main break- ages in the vicinity of the water main; @ implement, consistently and with reasonable care, the said policy and program for replacement and repair of the aging water main infrastructure, particularly with respect to the water m ain. The plaintiffs’ lawyer would not talk about the case. A spokesman for the municipality said the dis- trict’s insurer — the Municipal Insurance Association of B.C. — is taking care of the matter. oe in . Alberto Lozada was found guilty of one charge under the provincial Wildlife Act. He received a $200 fine and his guns, two .177 caliber air rifles, were ordered to be forfeited to the Crown. The conviction resulted from a tip by a resident of Anvil Island. The person reported seeing four peo- ple with guns on Christie Islet. The Howe Sound site is a migratory bird sanctuary. It offers important nest- ing area for gulls and cormorants. The West Vancouver Police inter- cepted the violators’ boat at Sunset Marina in West Vancouver. Conservation officers laid charges against Lozada under the Wildlife Act. The Ministry of Environment, Lands and Parks depends upon tips from the public to help to enforce environmental legislation.
