The act stipulated the pipeline would carry only Alaska gas to the West and Midwest in the United States and would have to be financed before construction began. But in 1980 a cabinet order allowed construction of part of the original pipe- line route before all financing for the reute had been obtained and provided the Americans with a sub- Stantial flow of natural gas from Alberta. The pipeline now carries 350 billion cubic feet of natural gas worth at least $1.8 billion a year to the American market. The Alaska pipeline that was to be the largest privately financed construction project in the world has been postponed indefinitely. “I am taking (Prime Minister Pierre) Trudeau and his cabinet to court to challenge what I say is an arbitrary abuse of power when in 1980 by executive order they changed fun- damentally an important act of Parliament without parliamentary approval,” Waddell said. Waddell, who fought three years to bring the case to court, was too late to stop the pipeline. But he said the legal challenge “would raise not only important issues about Canada's future energy security but is also a unique constitutional case crucial for the scope of nghts of Parliament ” The Vancouver politican said the cabinet “was at- tempted to change = this pipeline into a shorter export pipeline taking Alberta gas to United States market,” and thus violated Parhament's wishes.
