Wednesday, November 21 , 1990 - North Shore News — 7 _ Sager question no smear campaign Dear Editor: Re: West Vancouver Municipal Election ! am shocked and dismayed at the content of the Friday, Nov. 16 article in the North Shore News which, in many respects, is at odds with the information which | provided to the news reporter concerned, Ms. Elizabeth Coll- ings. At the West Vancouver All- Candidates meeting held at St. David’s Church on Tuesday, Nov. 13, 1 identified myself by name and asked Mr. Sager about a lawsuit in the Supreme Court of British Columbia and the ultimate Judgment therein, rendered Feb. 24, 1984, wherein the Honorable Mr. Justice MacKinnon held that Mr. Sager was “incredibly naive, irresponsible and negligent”’ in the representations he made to the Plaintiff in the case, Mr. Chris Nielsen. He was therefore found liable in damages to pay the said Mr. Nielsen some $231,000. Our law firm acted for the said Mr. Nielsen in his case against Mr. Sager and my partner, Mr, Richard Twining, actually was counsel on the case on behalf of Mr. Nielsen. It was as a result of our firm’s involvement with this case that it came to my attention on the very date of the aforemen- tioned All-Candidates meeting. Your bus: I determined that | would ask Mr. Sager about his involvement in this matter on that date as it seemed to me that the Judgment of the Honorable Mr. Justice MacKinnon spoke volumes about the character of Mir. Sager who was, of course, running for mayor of the Municipality of West Van- couver. When I posed the question to Mr. Sager at the All-Candidates meeting | prefaced the question by clearly enunciating the fact that anyone putting himself forward for public office is open to scrutiny, and that that includes his past record. Mr. Sager, in turn, prefaced his reply to my question by agreeing completely that of- ficials seeking public office are open to review of their past and public record such that the elec- torate can determine the character of those who would put themselves forward for office. In concluding his answer to my enquiry, Mr. Sager then told a “*half-truth”” to the assembly at the Ail-Candidates meeting by ad- vising that he had ‘won the case.”* In fact, Mr. Sager had not ‘*won the case’’ that I was refer- ring to, and he knew that. In fact, the Judge in the case ruled that Mr. Sager was responsible to pay our client some $231,000 in dam- ages and that, as quoted above, Mr. Sager was “incredibly naive. irresponsible and negligent.” There is no way tbat the aforementioned Judgment of the Honorable Mr. Justice MacKin- non could he characterized as a ‘win’? for Mr. Sager as he repre- sented at the AN-Candidates meeting. Mr. Sager and the North Shore News now characterize this completely relevant question which goes to the character of an individual offering himself as a mayoral candidate as ‘“‘A Pure Smear Campaign.”’ I submit that nothing could be further from the truth. Subsequently, when questioned by Alderman Rod Day, [ advised Mr. Day that I was supporting Mr. Macdougall for mayor. | did not advise Mr. Day that I was representing Mr. Macdougall in asking the question nor that I had been instructed by the latter to ask any question.
