You can atso suc in the place where the other party (the defendant) lives. There- fore, you must decide which place to’ sue based on cither where the cause of action arises or where the defen- dant lives. If you have any doubts, contact the Clerk of the Small Claims Court for advice. The next step is to decide ‘whom to sue. This is relatively easy where the defendant is a person. You merely need their full name . and address. Where you are suing a business you have to determine whether or not it is Incorporated, Incorpora- tion means that the company is legally registered — in Victoria. ' . How to start your debt action You should write to the Registrar . of Companies, Parliament. Buildings,. Vic- toria (enclosing $1.00) and ask for a. search of the company’ name. The Regis- .trar will tell .you if the company is registered, the - company’s legal name, its registered office (where you serve the papers), and the . names of the officers and . directors. If the company is incor- porated, ‘you name _ the company on the summons (the document that starts the action).
