Rooms range from $56 a night (chalet) to $135 (with fireplace) and something called ‘‘Friends of Timberline’ packages available — you'll have to phone the toll-free number and look them over yourself if you’ve a yen to try Timberline. They'll send you a big package of brochures. “You'll not find wild runs on the part of the mountain where Timberline is located, but if you want something more advanced, a 15-minute drive to the other side of the mountain is an area called Meadows, so it’s not 2 problem if your group has a few who want to do the odd bit of advanced ski- ing.”’ Geoff is definitely in the ad- vanced-skier department, s0 Timberline must be something special if he’s planning a visit in the summer! Answers published in this col- umn are intended only as a gener- al guide and should not be applied to individual cases without further consultation. eee Question: When I watch Amer- ican police dramas on television, { notice that the police always use the same words when they arrest someone. They say, ‘‘You have the right to remain sijent, but anything you say will be used in evidence against you.’’ The police also say that only one phone call will be permitted. I have always wondered if the sames rules apply in Canada. Is an arrest unlawful if the correct words are noi used? Also, if the police ask you ques- tions, do you have to answer or can you remain silent? Answer: In Canada the police can approach anyone, at any time, and ask questions, just as you or I could. There are no restrictions. The palice may also stop anyone they cansider to be acting suspiciously. On the other hand, unless the police have a legal reason to de- tain you, and are prepared to tell you that reason, you do not have to answer questions. Nor do the police have to tell you about your right to remain silent or that any statements you make could be us- ed against you in court. AS a suspect, you are not under arrest and so there is no require- ment for police to advise you of your right to retain a lawyer Straight away. When police start asking questions, you have the right to inquire about the subject matter. You also have the right to advise them that you wish to con- sult a lawyer before answering any questions. You may also request the interview be postponed until you have obtained legal counsel. If you are arrested or detained by the police you have the right which must be stated. Under the Charter of Rights and Freedoms, 1982, it is an express constitu- tional right that you must be in- formed about the right to retain and instruct counsel without delay. Failure to do this may result in dismissal of the charges or rejection of evidence obtained following what would then be an illegal arrest. The law says that the police shouid warn an arrested person of their right to remain silent before they interrogate him or her, but it is possible that a judge would admit the statements of an accus- ed person even if this warning was Not given. In the case of an arrest, the police must allow enough phone calls for the arrested person to contact a lawyer, either at the time of the arrest or after being booked at the police station. There are no limits as long as each call is a legitimate attempt to con- tact counsel.
