THE MEDIA spectacle which has become the trial of 0.J. Simpson now has a Canadian equivalent taking place in Toronto under the guise of the criminal trial of Paul Bernardo for the demented killings of two Ontario schoolgirls. On the same day as the Bernardo circus began, the Supreme Court of Canada ordered a new trial in the case of Terrance Burlingham, con- victed for the 1984 brutal sex- killings of 16-year-old Brenda Hughes and 20-year-old Denean ‘ormis. Mr. Justice lacobucci said in his reasons for judgment, “We will not bow to public pressure of the moment.” He stated the RCMP in Cranbrook, responsible for the investigation of the murders, were . guilty of “wilful and flagrant” viola- tion of the rights of the accused man. Burlingham was arrested in early 1985 and interviewed at length over a four-day period. It should be noted that he was allowed access to counsel and he miude the appropriate appearances in court during this pericd in cust.dy. As a result of the interviews, Burlingham confessed to the killings and led police to the weapon used in _ the killings, buried under the ice in the Kootenay River. Our law is based on the theory that an accused is innocent until proven guilty, Equally, the burden of proof is on the Crown, not on the defence and if there is a reasonable doubt about the accused's guilt, then he should be acquitted of the charge against him. These principles make perfect sense. But where is the retisonable doubt in the case of Terrance Burlingham? | ’ He brought the police to the mur- - der weapon. How can this be misconstrued by anyone? ‘ He did it. Period. If the learned justices determine his confession should not be allowed for whatever reason, { take no issue with that.’ But the simple fact that Burlingham took the police to the murder weapon should stand alone as evidence of his guilt. Daily our senses are assailed ‘ with the farce of a trial in the OJ. “ Simpson case. Notwithstanding all the other evi- dence, and the hilarious low- speed chase which included O.J.'s interpre- tation of the hostage scene in ‘ Blazing Saddles, the DNA evidence is irrefutable. ; Yet the best justice money can buy is putting the American judicial system through agony, making’‘all “ kinds of wild accusations claiming a police conspiracy to convict | Simpson because he is black. Nor would I suggest we abolish the Charter of Rights and Freedoms. _ Surely an element of common sense must come back into what can now only be laughably described as a justice system. There was a time when the most important goal of a trial was to find out the truth. This is clearly no longer the case. We now have direct evidence from the Supreme Court itself, indi- cating the truth no longer has a place in the courtrooms of Canada. Canadians are crying out fora leader who has the guts and the will to call for the requisite changes to our laws to encourage the focus back onto victims’ and society's rights.) °°: I don’t see such a person on the’ political horizon.
