Ramsay’s vehicle.

The two drivers exchanged
gestures until Ramsay got out
of his car and approached
Larson’s truck. With Ramsay
approximately three feet
from his vehicle, Larson
opened the driver’s door
whereupon Ramsay slammed
it shut on Larson’s leg. A
fight ensued.

Larson, the bigger of the
two, soon got the upper
hand. With Ramsay on his
back, Larson’s 15-month-old
Staffordshire Terrier sprang
from the box of Larson’s
truck and joined the scuffle.
Earlier testimony by
witnesses said that Larson
landed perhaps five or six
blows before being pulled
from Ramsay.

Addressing his client's pre-
sentence report, defense
counsel David Nuttal told the
court that what was at issue
was his client's degree of self-
defense. He called for a small
fine and probation,

‘*This was not a vicious at-
tack. No real harm was done,
no disability inflicted.”’

Nuttal said his client had
made arrangements to seck
psychiatric help and counsell-
ing for an alcohol dependen-
cy problem,

tarily had his dog put to
sleep,

Crown prosecutor Anne
Wallace argued that the court
had no alternative but to im-
pose a jail term, citing Lar-
son's previous assault’ caus-
ing bodily harm conviction.

serious, said Wallace. At-
titude of the defendent, she
added, was not good: ‘‘In the
witness stand he was
belligerent and remained con-
vinced that his actions were
justified.”’

Wallace said that Larson
had a problem with his
temper. A proper assessment
of his pyschiatric state could
not be made by a probation
officer, she argued.

Judge Paradis conceded
that the consentual fight bet-
ween Ramsay and Larson in-
volved degrees of proveca-
tion on both sides, but the ac-
cused ‘‘was certainly not
reluctant to get into it.”

Larson was assessed a $350
fine and put on probation for
one year. Conditions of Lar-
son’s probation included
undergoing psychiatric
counselling.

The Crown is considering
an appeal of the sentence.
