Sex [ From page t information. The nwo drove around in the car in) North Vancouver, The girl fell asleep. While she slept, Ng tied her wrists with clase cord. She awoke to find her hands numb because the cord was tied so tight. Ng told her not to fight. As she struggled, Ng strangled her, causing her nose to bleed. She bit his wrist and said she Jost consciousness. She was sex- ually assaulted while confined, according to the agreed state- ment of fact approved by the defence and prosecuting lawyers in the case. Said Mr. Justice . Bruce Cohen, “The circumstances of this case are exoremely trouble- some to the court.” The judge said that Ng's history of sexual crimes added to the concerns. He noted the young ages of the victims. In 1991 Ng was sentenced for the sexual assault of two girls ages 11 arid 16, Ng was 27 at the time. In 1990, he was sentenced for dangerovs driving. A young woman in the car with him “thought” he had attempted to rape her, according to informa- tion presented in court. Ng drove away with the woman half out of the car during the incident. In the late 1980s, Ng was sentenced for the unprovoked attack on a Hastings Street prostitute. Ng grabbed the woman by the throat and dragged her into an alley, but san away after people noticed what had gone on. Ng’s other crimes include an arson sentence in 1981, assault in 1986 and transporta- . ton fraud in 1988. - ‘The transportation fraud involved a cab driver whe reported that Ng threatene: “him with a butcher knife. Ng’s explanation of the incident was that he bad nor threatened the cabbie, but the cab driver may : have seen some of Ng's knives » that he was using for chef train- ing at the time. Crown lawyer Greg Weber .. pointed out that Ng usually had .“a different version of -events” for his crimes includ- ing, the sexual assault. Ng's anti-social criminal behavior was noted at around age 12. ‘| Ng’s lawyer Patricia Connor was critical of a 30-minute interview of her client by Dr. Clifford Kerr on. April 2. Connor thought the doctor was to do‘a psychiatric report, ‘but he did a pre-sentencing report instead, The defence lawyer said Ng didnot feel comfortable with the doctor. “Mr Ng is essential- ly’ an_ extremely shy person,” said Connor. She had expected the doctor to conduct more than once interview before mak- ing, a report. Connor said that Ng had been in custady for almost two years, since his arrest for the crime. She asked the judge for “credit” for the time Ng spent in jail at “the usual rate.” Connor said that the two years Ng spent awaiting his sentence would.be the equiva- lent of a four-year jail sentence. ' “If he is given four vears (by the judge on Monday), he will- have done the equivalent. of eight years,” said Connor. Accused people who spend time in jail awaiting the out- come of their charges are said to be serving “dead time.” These people are believed, by some, to be serving more tiarsh jail time as they do not partici- pare in rehabilitation programs. Neg pleaded guilty to the aygravated sexual assault charge one vear ago. Crown and defence lavvers teok months to arrive at an agreed statement of fact as to what happened during the aggravated sexual assault. Ng's lawyer said Ng had an carnest desire to be rehabilitat- ed. But Crown lawyer Weber said Ng was not willing te par- Gapre in a psychiatne assess- ment. Court information indicat: ed that after Ng was sentenced for sexually assaulting nwo girls in 199L, he did not regularly report to a probation offtcer or take counselling as ordered.
