Court of Appeal delivered to a young offender last Thursday in Vancouver. The youth was one of five peo- ple charged in the December 1990 kidnapping of Cynthia Kilburn, the daughter of West Vancouver business magnate Jimmy Pattison. The youth, who cannot be iden- tified under the Young Offenders Act, had been sentenced on five charges to three years in secure custody. He had pleaded guilty to kid- napping Kilburn, using a firearm, extortion, possessing stolen money and confining two infants. Lawyer Phil Rankin centred his appeal on two main grounds: @ he contended that the initial trial judge had not considered the youth’s rehabilitation prospects; @and he contended the judge had not sufficiently considered Ms. Kilburn’s favorable state- ments about the offender. The kidnapping made national news when it unfolded just four days before Christmas. Kilburn was grabbed, taped, gagged and dragged from her North Vancouver home. Her two terror-stricken five-year-old children were blindfolded, bound back-to-back, and Ieft for seven hours before being rescued by the police. The gang dcmanded an $8.5 million ransom from Pattison.
