Alderman Bill Sorenson expressed his concern at Monday's council meeting, following a report from the City’s engineer on the nar- rowing and diversion of the creek by the band. In the past few years, fill- ing has been carried out by the band on its property ad- jacent to Mosquito Creek and the most recent filling occurred about six weeks ago, City Engineer, Tom Scott, told council. The filling is restricting the water flow at the mouth of the creek, and diverting it towards the City’s bulkhead at the seawall, Scott charg- ed. The interference with the flow of the creek could result in flooding at the foot of: Bewicke Avenue and damage to City and public property, according to Scott. Scott added he has written to advise the band of the possible consequences of restricting the flow of Mos- quito Creek. But Mayor Jack Loucks pointed out that the band could ignore a letter and he told council a phone call would be more effective. Council should approach the government agencies in charge of the lands, Alder- man Gordon Cross sug- gested, but Loucks pointed out the federal authorities have ignored letters from the City advising of the situa- tion. And letters have been sent since June, 1978, Alderman Stella Jo Dean told council. Scott advised council to direct the City solicitor to serve the band with formal notice holding the band responsible for any damage to City or public property caused by the filling in. Council should follow all the suggestions, Loucks told the meeting, and contact the City solicitor, the band and the federal agencies involv- ed. UNAWARE But Sorensen argued that the people responsible for the filing in of the creek may not be aware of coun- cil’s concern and should be given an opportunity to res- pond to Scott’s letter before further action is taken. Council doesn’t want a confrontation with the band, Alderman Garry Payne agreed, but he added that the foot of Bewicke Avenue is part of the city’s limited | INDIAN. Council finally voted to re- quest federal, provincial and harbour agencies involved to restore the creek to its original state as well as ad- vising the band of its respon- sibihty for any damage that might result from the filling at the creek mouth.
