Last week, Health Canada announced the regulations will be formed to address some of the issues relating to transparency of the process and provide a clear definition of medical necessity. The move is related to a July 33 Ontario court of appeal, decision concerning the use of inal marijuana. The Court declared the prohibition on the possession of marijuana in the Controlled Drugs and Substances Act (CDSA) to be uncenstitution- at and of no force and effect. That declaration of inva- lidity was suspended for a year and does not effect ‘law enforcement in B.C. relating to marijuana. Health Canada states the new regulatory approach will define the circumstances and the manner in which the. use of marijuana for medical pur- poses will be authorized. Federal health = minister Allan Rock said the new process will bring clarity and define the process for Canadians who request to use the drug to alleviate pain and suffering.
