There is plen- ty of controversy over the real mean- ing of the Delgamuukw decision, but One thing is for certain — lots of lawyers are already rubbing their hands together with glee at the thought cf all of the work coming their way. For an opposing point of view on the ruling, just look to Mel Smith Q.C., for example, who considers Delgamuukw to be an appalling piece of judicial activism in the light of the years of deliberations in BC prior to the referral to the highest court in the land. In Australia, a Delgamuukw-like tuling about a decade ago produced so much uncertainty that the _ Australian Government is in the process of legislating aix end to the and claims. MY COMMITMENT “| have no doubt that supporters of _|_ the Nisga'a Treaty are motivated by a genuine desire to see that past wrongs are settled and that new opportunities to participate are provid- ed for our aboriginal peoples. in their letters to me though, | had trouble finding logical, as opposed to emo- tional, reasons why the Nisga’a Treaty as it stands should be passed into law. In addition | worry about the fact that 40% of the Nisga'a who voted on this deal voted AGAINST it. Based on peti- tions containing 244 signatures | have received from Squamish Band Members with respect to a Bill about Native Land Management which is presently before Parliament, | cannot help wondering whether they are afraid that more money and power will flow into the hands of the Chiefs while the rank and file continue te live ‘in poverty. This, sadly, is the evidence from a number of reserves across the country. The Samson Cree Reserve, for example, nas revenues exceeding - $110 miltion per year from oil and gas royalties, yet 80% of its members live on welfare, many without phones or cars. Handing over money, power, and responsibility does not automati- cally guarantee a better life for the people on reserve. Irrespective of my present posi- tion with respect to. the Nisga'a Treaty, | am personally committed to doing everything possibie to accurately represent the majority will of this Riding in the Parliament of Canada. | am therefore encour- aging those of you are supportive of the deal to do your best to con- vince a_ majority § of North Vancouver voters to come around to your point of view.
