Stewart engaged the ser- vices of Einar Carlson, a former district chief building inspee- tor, to investigate whether Kotyk was given any special treatment by staff, whether there were any breaches of the district’s conflict. of interest policy and whether any other pertinent “procedural, opera- tional, or conduct issues” had been raised. Carlson concluded that Kotyk did not receive preferen- tal treatment and thar staff had suictly applied the appropriate standards and regulations. However, among his find- ings Carlson confirmed that Kotyk started work on a pier/dock without the appro- priate permits in place from the Department of Fisheries and repaired an unauthorized road built by a former owner in con- travention of permit terms. Stewart’s report concludes: *... Kotyk exercised question- able judgment when he allowed work to commence on his pier/dock in advance of receiving the — necessary approval from Fisheries and Vancouver Port. “He exercised further ques- tionable judgment in not bringing this action to the dis- tict’s attention unul it was reported and then not acknowledging until chal- lenged that he was aware the work was going to be carried out without the necessary per- mits in place.” With regard to the road- work, Stewart concludes Kotyk either “deliberately chose not to inform statt” or “was negli- gent in failing to do so before work commenced.” Stewart also. says Kotyk “ought to have recognized the impact of his behavior” regard- ing his conversations with statT about his own permit process. “His conduct has had repercussions in terms of his direct staff's and other stalPs perception of him.” Kotvk declined to com- ment to the News. But in a written response to Stewart’s in-camera report Kotyk says all district permits were “applicd for and adhered to.” Kotyk also wrote: “In con- clusion the report calls for some form of district action, on the balance of facts, the only action necessary is to examine che manner in which investigations are conducted and the cost to taxpayers and staff morale.” The cost to taxpayers may yet be measured financially, if a projected settlement of seven to nine months salary is nego- tiated.
