collision claim means losing dis-

Not always. In fact, there are
situations where motorists can call
on their collision coverage without
any loss of discount.

Take a situation that occurred
on Vancouver Island a few years
ago. A motorist was passing by a
trio of pedestrians. Suddenly, one
of them jumped or was pushed or
jostled out into the roadway. The
motorist swerved and hit a parked
vehicle causing a fair bit of dam-

The issue facing the SCBC
claims adjuster and the vehicle
owners was to determine who was
responsible (legally liable) for tne
damage. This involved the ‘test
of a reasonable person”? we
covered a few weeks ago.

In this case the motorist swerv-
ed to miss a person suddenly ap-
pearing in front of him — not an
unreasonable thing to do. The
driver was clearly not responsible
for the damages and the owner of
the parked vehicle could not make
a third party liability claim against
him.

However,

unless someone

proved the pedestrian caused the
accident, both motorists would be
responsible for their own repairs.

That means they would have to
make collision claims.

The owner of the parked vehicle
did not carry a collision coverage
so he could not make a claim to
ICBC. His only recourse was to
sue the pedestrian and try and
prove that person was at fault.

The driver had collision
coverage and was able to make a
claim io ICBC. However, because
of the circumstances leading to the
claim, it was referred to ICBC’s
Discount Review Committee.

The committee studied the
details and determined that al-
though the driver was going to be
responsible for repairing his vehi-
cle, he was not liable for the acci-
dent and would not lose his
Claim-Rated Scale discount.
