nailbox fire bylaw victims? Dear Editor: Further to the letter of Alderman Stella Jo Dean published [lth Aug. last. Available space prevents more than a brief presenta- tion of relevant facts. I} would like to) mention that all tenants, strata ttle owners and residential or commercial building owners, in the Ciy of North Vancouver, are the bene- ficiaries of the successful stand taken by Mr. and Mrs. Gordon Rogers, in our courts, in respect to our City administration and in particular our Fire Depart- ment. Our problems seem to date back to 1971 with the adoption of an amendment to our Fire By-law. The amendment was intended tu give the Fire Chief unlimited discretionary powers in selling standards, ordering works or what ever. This amendment had one fatal flaw. It ts not within the City’s power to delegate such authority. Council alone must rule on such matters. One doesn't require a lepal mind to picture the con- sequences of allowing department heads to change the rules from time to time as they saw fit. The council by adopting such a Bylaw. whether it was Ultra Vires or not, invited abuses. Fire officials have in- structed building owners to engage outside, privately- owned fire prevention com- panies at considerable cost, to periodically inspect their fire equipment. This not- withstanding that inspection is what we pay them to do. It being specifically the res- ponsibility of our own paid fire officials. Because the Landlord and Tenant Act provides that the landlord may pass off these costs to the tenant, the last invalid order is estimated to have cost tenants, and others close to $1,000,000. This raises many questions to which answers will no doubt be forthcoming. 1) Does the City of North Vancouver intend to compensate these 5,500 tenants who have been the chief victims of inept City administration. 2) Is the City prepared to reimburse the property owners who were dragyed into court for not obeying Will NV City compensate this invalid order. and who were fined sums as high as $500 each. 3) Are the City ad- Mministrator, Mayor and council prepared to reim- burse Mr. and Mrs. Gordon Rogers their legal expenses. For the present the City administration is engaged in an exercise in stonewalling. They have known for a long time that their By-law 1s in fact Ultra Vires, they have seen the consequences of enacting i, in the first in- stance. To date the By-law has not been repealed. They are wrong if they think nt will just go away.
