By Kevin Gillies Coutribuing Writer North Vancouver City (NVC) Council resolved this week to ask the Federation of Canadian Municipalities (FCM) to lobby the federal government for more con- trol over where adult video stores and movie theatres can set up busi- ness in the city. : The move followed the opening of an Adults Only Video retail out- let at 732 Maritic Dr. Geoff Wheale. a business owner who operates out of the same facili- ty as the new video store, is upset about his new neighbor. He's concerned that the image of his business could be tarnished. Councillors Barbara Perrault and Stella-Jo Dean had voted against issuing the Adults Only operation a licence, favoring a pub- lic hearing first. But the adult video store was issued a business licence because council realized that any refusal to grant Adults Only a licence could be challenged under the Canadian Charter of Rights and Freedoms. Council subsequently passed the FCM resolution to lobby Ottawa for help in controfling where adult video stores can set up business. The resolution stues that adult video stores and movie theatres can have significant impacts on a com- munity and that the chirter pro- hibits municipalities from regutiu- ing such businesses, The resolution's vote was sup- ported by all councillors except Bill Ball. Municipal zoning bylaws and business licensing, he said. were not set up to deal with moral issues and should not be used its such. “Um almost embarrassed that a motion like this is going to the FCM.” he said. But city Coun. Stella Jo Dean disagreed. She said adult videos, in many cuses, weren‘t normal and con- tributed to violence against women by “turning on” people who might be “unbalanced.” As for where adult video shops should be located, Dean said: that the rights of the community should outweigh the rights of the individ- ual. “f thought the matter should be brought before us and the commu- nity in a public hearing,” she said. She said council should be let- ling people know an adult video business is seiling up in their com- munity. and that residents should have the choice to say whether they wanted the business there or not. Dean said the outlet was open before council approved its licence. She added that another adult video outlet also applied to open a store on Third Street, but when the building's owner found out what type of business it was, he disal- Jowed it. The company, Dean said, has not reapplied. City mayor Jack Loucks said, “I: don't think we should be interfering with people's rights and freedoms, (but) we want the right to prohibit them if they're located in the wrong phice.” He said council is asking the federal government to give up something that is in its control.
