My lawyer tells me that there is a very good chance my wife will receive a one-half interest in my business assets which mainly vor- _ sist of my shares in the company. Apparently she will also get a one-half interest in all of my ‘RRSPs, stocks and bonds and bank accounts in addition to our | matrimonial home, which I owned prior to my meeting her and which is clear of ail encum- braaces. . My main concern is that if my wife obtains any of my shares and manages fo alienate my pariners from me, I will lose control of my company and therefore ‘suffer economic loss in the future. My wife has had two business failures. One occurred prior to our meeting and the second oc- curred when her women’s clothing store failed three years 2go. She is quite unabie to manage money and dots not seem to have a sense of what is necessary to run & successful business. She also is a very vindictive person, which is one of the reasons the marriage has failed. What can I do to stop losing the control of my company if I cannot negotiate a-settlement with her so that I can keep the shares? It is highly unlikely that a court, even if it awards an interest to your wife in your shares of the company, would allow her to re- tain that interest once they have been properly valued and there is a prospect of payment to her by you for her interest. Once values are obtained for ail of your assets and hers, you should then attend on your ac- countant as well as your lawyers to ascertain how you can pay for her possible interests. in. your shares. : Ie may be that transferring the stocks, RRSPs and greater than one-half share of the home will satisfy any interest she may have. Certainly if the matter proceeds to court, the judge will be ex- tremely interested in how you are going to satisfy payment of her interest in the shares and therefore you should be well prepared with both valuation and accounting ev- idence. As to whether she will gain an interest equal to yours in the company, we cannot comment. Ceriainly, once a business asset becomes a family asset through the direct or indirect contribution of the other spouse, it is to be divided in half unless the court otherwise orders, pursuant to sec- tion 51. One of the considerations that a court takes into account in deter- mining the percentage interest and what is to be paid to the non- owning spouse is the fact that normally the owner of the shares must continue to suffer the burden of substantial financial obligations for the running of the company and a substantial coim- mitment of time to properly real- ize on the value of the shares.
