Over the course of time, for many dif- ferent reasons, the residential properties affected have expanded to include portions of municipal or (in the case of the West Van shoreline) Crown land. Frequently, the en- croachment (ook place years ago = and sometimes the present innocent property owner may not even be aware of it. Both councils (West Van as agent for the province which owns the foreshore) are now preparing to regularize such situations -- first by having the encroachment’ formally recognized. That done, both councils have indicated that their general policy, subject to individual circumstances, will be to allow continued use of the encroachment provided there is no harm to the public interest. But henceforth the use will have to be on a ‘*tenancy’’ basis, meaning payment by the property owner of rent or a fee-for-use. The scale of payment remains at the moment the subject of debate and, again, may vary from case to case. It could be the going market rate for the amount of en- croached land or even, in certain circumstances, a nominal dollar-a-year. Among other important points is the ques- tion of legal liability, which the property owner will likely be required to assume with his lease. Regardless of the eventual details, however, the fundamental principle can hardly be contested. If you're using someone else's property, you have an obligation to pay for it.
