Brent Kelly recalled the scene of July 13 as he escorted a — handcuffed Caouette to the back seat of a police car and charged hin with two counts of attempted “murder. The seven-year veteran said a colleague rushcd down from Caouette’s suite where a two children lay bleeding from head wounds and told him: “It doesn’t Jook good.” At that point, said Corist. Kelly, Caouctte —- who did not appear drunk or drugged -— was charged, read his Charter rights and told he could contact a lawyer. all of. which he acknowledged. Const. Kelly told the B.C. Supreme Court trial that he arrived at 130-West Fifth Street, North Vancouver, at about 8:10 a.m. in response to a 9-1-] call from suite 306. _ A-man called the emergency line from that apartment and told a dispatcher: “I just killed my kids.” When he arrived, he saw the neatly dressed Caouette _e sitting on the stoop of the apartment building. He was istressed and appeared to be crying. Caouette is charged with the first-degree murder of his 10-year-ol daughter, Danielle, who died about a week after being attacked with an‘ axe. He is also charged ‘with the attempted murder of ‘his 14-year-old son, Joshua, on that summer day nearly two years ago. _ The Crown contends Caouette acted out of rage ‘against his wife, from whom “he -had been separated, and took it out on. the couple’s : children:, They had. been ted a rare overnight stay at their father’s shared suite in ” Lower Lonsdale. »+ « Const. Kelly said he searched Caouette and found a wallet. It contained identifi- cation and a set of keys to the building and suite. Other Mounties described Thursday how they entered the bedroom and saw the two children lying almost together and completely covered in bedding. When Const. Ehran Toyata entered the room, he saw two bodies under what he took to be sleeping bags. He could hear snoring. He said Danielle, who was DANIELLE Caouette died of injuries sustained on July 13, 1995. attacked on her birthday, was laying on her back and breath- ing erratically when she was uncovered. “I noticed blood and what appeared to be a hole in her head,” he told Justice Allan Thackray and the jury. He left the suite to update Const. Kelly. The chil- dren were alive, he reported, but barely so. Const. Toyata travelled with Danielle to Lions Gate Hospital and remained with her as she was transferred trom the operation room to intensive care and later in the day to B.C. Children’s Hospital in Vancouver. Later that day, a search was made of the apartment’s underground _ parking lot. Const. Wayne Knapman remembered handling a num- ber of items found by the searchers in dumpsters and recycling boxes. Among them, he explained, were bank statements, a letter on which the name Diana was written, children’s report cards in the name of Caouette, “religious- type” pictures, and a snapshot of a girl. Sgt. Peter McLaren testi- fied that he reached the scene at 8:36 a.m. -— a few minutes before a frantic Diana Roxburgh, Caouette’s wife of 16 years, arrived. He broke the horrifying news. Later that morning, he said, he talked with Caouette in ‘the North Vancouver RCMP detachment lockup and examined his legs for traces of blood. None was found.
