How soon must a report be made snd how extensive must it be? Must one go in to ICBC to give a full statement? The main reporting duties are set out in Section 73 of the [CBC Regulations and the Motor Vehicle Act. They require the person involved in an accident to do the following: 1. Promptly provide [CBC with written notice with all available particulars of any accident involving, death, injury, damage or loss in which a vehicle either driven or own- ed vy the insured has been involved. 2 If you are involved in an accident with damage to persons or property apparent- ly exceeding $400.00 you must ceport the accident with all particulars to a Police Cffice. These reports when filed with the Police are available to [CBC at any time at its request. 3. If you are sued, you must cooperate with ICBC in the investigation, settlement and defence of the lawsuit against you. Note that there is no requirement to actually attend at ICBC to provide the in- formation in question, simply that the statement setting out the materia! particulars be in writing. Presumably mailing of such a notice would suffice. If you are sued however, cooperation in the defence will require you to do all reasonable things which defence of your action may require, including mecting with ICBC lawyers, attendance at discoveries and trial, etc. Failure to provide written notice to ICBC following an accident, or failure to cooperate in the conduct of the defence of any litigation may jeoperdize your insurance coverage. If you have concerns with respect to the legal responsibility ior an accident in which you are involved, it might be wise to discuss the contents of the written notice with legal counsel before providing same to ICBC. In my next column J will discuss tawyers and contingent fees.
