Two major auto com- panies have been sued for damages as a result of car accident deaths. Toyota has already been found guilty of negligence and ordered to pay $5 million in damages, while Ford has just been sued. The families of three teenagers burned to death in a rear-end car collision are seeking $113.8 million in damages from Ford Motor Co., claiming a 1965 Mustang involved in an accident had at least nine design defects. U.S. District Judge Carl O. Bue Jr. of Houston an- nounced Tuesday afternoon that obstacles had been cleared for testimony to begin today before a four- man, two-woman jury. “It is a significant case — one that has some problems in it legally,” Bue said. Court officials have scheduled at least eight days for trial testimony, but some court observers say the hearing could take more than two weeks. Attorneys for the sur- viving families allege the Mustang, a popular model manufactured by Ford, had at least nine design defects, including “a vulnerable location of the fuel tank” and a lack of a firewall barrier between the trunk and the rear seat. The suit was filed by the families of Hector D. Arizmendi, 16, Carlos Luis Garcia, 16, and David Lyssy, 17, following the March 12, 1978 accident. Katherine A. Flint, who suffered severe burns in the collision but survived, also has joined the lawsuit. The suit claims Robert G. Schach stopped his Mustang along a Hidalgo County road in south Texas and got out to try to render aid to people involved in a_ two-vehicle accident. Arizmendi and Garcia, who remained in the Mustang, were trapped when it was hit from behind by a car driven by Lyssy. Arizmendi and Garcia burned to death in the Mustang and Lyssy, who suffered severe burns, died several days later in a county hospital. Flint, who was riding in Lyssy’s car, also was burned. Meanwhile, Toyota Motor Co. must pay a family $5 million for the deaths of three sisters in a fiery crash two years ago, a _ Ford Lauderdale circuit court jury ruled.
