According to the city’s bylaws, 12 mionths must elapse between rejection of an application and re-submission of a proposal that is substan- tially similar. Brant, of — Cardinai Management Ltd., has not changed anything in his pro- posal for a neighborhood pub to be built on his property at 850 Marine Drive. Despite the bylaw, council! voted 5-2 to approve the re- application. Councillors John Braithwaite and Stella Jo Dean were opposed. The majority of council changed its mind on the pub proposal because most felt Brant was treated unfairly. Brant was midway though his application process when council decided on April 7, 1997, to pass a new bylaw. It required that a survey be con- ducted of residents and busi- nesses located in an 800- inetre radius of the proposed pub, and that a minimum 60% of voters be in favor of the development. Brant had already spent $10,000 on a referendum, but council rejected his pro- posal because only 54.5% voted in favor ofa pub in their neighborhood. A total of 1,129 ballots were cast during 2 one-month period. Coun. Darrell Mussatto said he wanted to “show com- passion” by giving Brant a second chance. “He’s doing the survey at all cost to him. I have no problem with this,” he said.
