DISTRICT COUNCIL | By Maureen Curtis Joseph Whiteside wanted to remove a rock bluff from the rear of his property to open up the view. “My intention still is to make aximum use of my property,” said Whiteside, at the May 2 meet- ing of West Vancouver Council. He purchased the property in 1986, and built his home shortly after. During the winter of 1992- 93, council passed a stricter rock and soil removal bylaw that restricted the amount of material that could be removed from a piece of proper- ty and increased the safety regula- tions governing the blasting proce- dure. Under specific conditions, blast- ing and other sorts of rock removal are permitted, but only to facilitate siting a house, or for the placement of a driveway and utility limes. “Your bylaw, when applied to me, is excessive and totally unjusti- fied. I want my dream house and I want to use and enjoy my proper- ty,” said Whiteside. He ‘pointed out that fewer than two yards of material had been temoved or added in the past. One of Whiteside’s neighbors, who lives below the rock bluff, came to council to protest any pos- sible rock removal. He was concerned about rock coming down upon his property, but also about the possibility of altering what has been considered an attractive natural feature. “Your rock is another man’s pet,” observed West Vancouver Coun. Andy Danyliu. He pointed out that a variance from the blasting rock removal bylaw generally necessitates a demonstrable benefit to the com- munity at large.
