Question: I was involved in an accident when my car collided with another at an uncontrolled in- tersection. Both of the cars were damaged. ICBC says that the acci- dent was my fault, but ¥ don’t agree. I feel sure that the other driver was speeding, and that I am just being blamed because I am young. How do I convince ICBC to change their decision? Answer: If you are not happy with your ICBC adjuster’ 's decision you can ask to see a unit manager, who will review your file and ex- plain ICBC’s policy on the assess- ment of liability. If there is stil! no agreement you can ask to see the claim’s office manager, who will try to resolve the problem. If you are still not satisfied you have to choose between two courses of action. Either you can sue the driver of the other car or you can request a review by the Claims Review Committee. If you choose to go before the Claims Review Committee you must request a review within 30 days after you were told of your liability by the claim’s office. You must complete a ‘Claims Review’ form and pay $25, which will be refunded if the reviewer agrees with your position and changes the decision of the adjuster. If the Claims Review Committee upholds the decision of the ad- juster you no longer have the op- tion of suing the driver of the other car, which is why some peo- ple are wary of choosing this course of action. If you choose to. sue the driver of the other car you must start the action within two years of the ac- cident. If the claim is for $3,000 or less you can sue in Small Claims Court and you can conduct the case yourself, and avoid the cost of a lawyer. If the amount is larger than $3,000 you would have to vrake the case to County Court or Supreme Court, in which case you should consult a lawyer. Question: My husband and { are both seniors. We don’t have many assets but we have been advised to pat what we have into joint names so that when one of us passes on, the other one will not have to go to the trouble and expense of pro- bating a will. Our car is registered in joint names. I was wondering, if one of us had an accident, would the in- surance cost go up for beth? Answer: When you insured the car either your husband or yourself will have been named as the prin- cipal driver. It doesn’t matter which of you is actually driving when an accident occurs, the one who is named as the principal driver is the one whose record is affected. If you make a claim through ICBC and you are found to be at fault, then your insmance cost will increase. You could change the name of the principal driver from the hus- band to the wife, for example, ia order to use a more beneficial safe driver’s discount. You would have to cancel the existing policy and take out 4 new one. But be cautious if you are think- ing of doing this.
